Texas Judge May Appeal Public Warning

The Texas Commission on Judicial Conduct's recent public warning to the state's Court of Criminal Appeals Presiding Judge Sharon Keller is not the equivalent of an exoneration, censure or removal. It is the least harsh in the possible sanctions which the Commission could have given Judge Keller, whose 2007 conduct was called into question when she closed her office, preventing the filing of an appeal in the case of Texas death row prisoner Michael Wayne Richard. Her action violated day-of-execution procedures and resulting in Richard's  execution. But attorneys for Judge Keller say she may still appeal the public warning, according to the Austin American-Statesman.
